Often, the police will charge a suspect with the offense of possession of narcotics with intent to sell or distribute based on alleged “indicia of sales.” Examples include possession of narcotics in separate bags with pre-measured weights, large amounts of currency, scales or other measurement devices, “owe sheets,” text messages indicating drug transactions, and a suspect’s statement or admission. Possession with intent to sell or distribute is a felony offense and its penalties are more severe than possession for personal use.
